At its December 15 hearing, the Memphis and Shelby County Air Pollution Control Board voted 6–1 to dismiss an appeal concerning the permit for 15 turbines at xAI’s Colossus 1 site. The reported basis was mootness. This is a distinct disposition milestone, not the July 16 filing. Dismissal on mootness grounds should not be described as a finding that all disputed turbine operations complied with federal law. Colossus 1 is xAI’s AI supercomputer facility.
